Traveling before Wukuf, the congregation must pay the check if they make a wrong move
Currently, all the Hajj pilgrims who landed in Medina have entered Mecca to perform the first Umrah, some arrived two weeks early and others have just set foot in the Holy Land.
There is news in the Holy Land that there are Hajj pilgrims who have performed Miqat from Medina and completed the first Umrah and have left the Haram again for Hajj or traveling beyond two stages, such as to Taif, Jeddah and several tourist areas.
The act of traveling or making a pilgrimage before Hari Raya Masayir is actually not recommended because it can have several legal and sharia implications.
Congregation Leaves 2 Marhalah
Hajj pilgrims who leave Mecca for more than two stages, such as leaving for Taif before the Peak Day of Hajj or Wukuf and do not intend to enter ihram for Hajj or Umrah when re-entering the Haram, may be subject to isa’ah of command and destiny, namely the obligation to slaughter a goat.
This follows a handful of Hajj pilgrims from Malaysia who had completed the Umrah pilgrimage reportedly leaving Mecca and heading to locations more than two marhala away (more than 81 kilometers) such as Taif or Jeddah for travel or pilgrimage purposes before Wukuf Day.
Hajj Referral Expert, Dr Mohd Sirajuddin Siswadi Putera Mohamed Shith said, pilgrims leaving Mecca for locations such as Taif before Masyair Day need to understand the implications of the laws and regulations set by the Saudi Arabian authorities to avoid worship problems and face security problems.
He explained that the legal implications depend on the type of Hajj performed, whether ifrad, qiran, or tamattu’.
According to him, ifrad and qiran pilgrims who are still in ihram have no problems leaving Mecca even though they pass through two marhalah or miqat areas.
There are no legal implications because he is still in the state of Hajj Ihram.
Tamattu’ Hajj pilgrims are required to renew their Ihram
“However, for Hajj pilgrims who have completed the Umrah and are free from the prohibitions on Ihram except for the prohibition on cutting down plants and hunting wild animals in Makkah Haram, it is obligatory to have the intention to re-enter Ihram, both for Hajj and Umrah, when they want to enter Mecca after leaving Taif,” he said when met recently.
According to Mohd Sirajuddin, if tamattu’ pilgrims choose to intend to hajj at a miqat such as Wadi Mahram in Taif, they can continue the pilgrimage without being charged additional taxes.
However, he said, if they return to Mecca without intending to perform the Hajj or Umrah, they are considered beyond the miqat without ihram and are worn the isa’ah dam in addition to the existing tamattu’ dam.
Mohd Sirajuddin explained that based on the Decree of the 36th Hajj Season National Muzakarah 1441H/2019M, If the Tamattu Hajj pilgrims go to Taif before Wukuf, then they must intend to perform the Umrah Ihram at least in Qarnul Manazil because they intend to perform the Hajj when they enter Mecca.
The resolution states, if the pilgrims who go to Taif intend to perform the Hajj at Qarnul Manazil, then the Hajj is the Hajj Tamattu’ which is not subject to orders and taqdir because it has returned to its original miqat or one of the five miqats for the intention of Hajj.
